Who is responsible for data collection?

SERAG-WIESSNER GmbH & Co. KG, zum Kugelfang 8 – 12, in 95119 Naila, is the “controller” for processing your personal data within the meaning of the EU General Data Protection Regulation (GDPR). You can contact the above address at any time with any other questions on the topic of data protection.

How do we collect your data?

On one hand, your data are collected when you provide such data to us, e.g., on the telephone or by filling out our contact form.
Other data are collected automatically by our IT systems when you visit our website. These are primarily technical data (e.g., Internet browser, operating system or time of page view). These data are collected automatically as soon as you access our website.

For what purpose do we use your data?

We collect, process and use personal data to the extent necessary to establish, design the content of or modify our legal relationship (inventory data). Personal data regarding the use of our Internet pages (usage data) are collected to the extent necessary to enable the user to utilize the service. The collection of these data ensures that the website is made available error-free.
We use your personal data to process your (online) purchases from SERAG-WIESSNER GmbH & Co. KG and to send you delivery status notifications or notify you of problems with the delivery of your items. We use your personal data to process your payments. We also use your data to process complaints and product warranty claims. Your personal data are used to determine your identity and ensure that you have reached the legal minimum age to make online purchases. We also use your data for advertising purposes. This serves, among other things, to inform you of new products, discount campaigns, and the like.

The legal basis for processing your data

The GDPR is the legal basis for the processing of personal data to the extent we obtain the consent of the data subject for processing operations with personal data.

How long are your data stored?

SERAG-WIESSNER GmbH & Co. KG only stores your data as long as this is necessary for certain purposes. Your data are erased as soon as the relevant legal basis for processing your data no longer applies, a legal obligation requires erasure, you withdraw your consent to the processing of your data, or you have validly objected to the processing of your data.
Statutory retention periods remain unaffected.

Sharing your data with third parties

We only send personal data to third parties (for example, to transport service providers) when this is necessary for contract implementation. No further transfer of the data takes place or, if so, only if you have expressly consented to the transfer. We do not share your data with third parties, e.g., for advertising purposes, without your express consent.

What are your rights with respect to your data?

Right of access
You have the right to receive information about the origin, recipients and purpose of your stored personal data at any time free of charge.

Right to rectification and erasure
You have the right to request prompt rectification of inaccurate data relating to you as well as completion of the data about you stored with SERAG-WIESSNER GmbH & Co. KG. You also have the right to erasure of your data. In this case, the data must, for example, no longer be needed for the purpose of processing or, with respect to non-technical data, you must have validly withdrawn your previously granted consent. The right also exists if you have objected to the processing, the data processing is unlawful or there is some other duty to erase under national or EU law.

Please note that you have a right to erasure only to the extent that we are not required to keep your data for a statutory retention period. Moreover, data we need for the establishment, exercise or defense of breaches of law are excluded from the right to erasure.

Right to restriction
You have the right to request restriction of the processing of your personal data. You can contact us for this purpose at any time at the address given in the imprint. There is a right to restriction of processing in the following cases:

  • If you dispute the accuracy of your personal data stored with us, we generally need time to check this. You have the right to request restriction of the processing of your personal data while we are checking.
  • If your personal data were or are being processed unlawfully, you can request restriction of data processing instead of erasure.
  • If we no longer need your personal data, but you need it to establish, exercise or defend legal claims, you have the right to request restriction of data processing instead of erasure.
  • If you have filed an objection under Art. 21 para. 1 GDPR, a balance must be struck between your interests and ours. As long as it has not been determined whose interests predominate, you have the right to request restriction of the processing of your personal data.

When you have restricted the processing of your personal data – with the exception of storage – the data may only be processed with your consent or to establish, exercise or defend legal claims or to protect the rights of another natural or legal person or based on an important public interest of the European Union or a Member State.

Right to object
When data processing is based on Art. 6 para. 1 lit. e or f GDPR, you have the right to file an objection to the processing of personal data at any time for reasons relating to your personal situation. This also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this Data Protection Notice. If you file an objection, we will no longer process your affected personal data, unless we can demonstrate compelling legitimate grounds for processing, which override your interests, rights and freedoms, or the processing is for the establishment, exercise or defense of legal claims.
If your personal data is processed for the purpose of direct advertising, you have the right to file an objection against the processing of personal data relating to you for purposes of such advertising at any time. This also applies to profiling, to the extent that it is connected to such direct advertising. If you object, your personal data will no longer be used for purposes of direct advertising thereafter.

Withdrawal of your consent to data processing
Many data processing operations can only be undertaken with your express consent. You can withdraw a previously granted consent at any time. An informal e-mail notice to us is sufficient for this. The withdrawal does not affect the lawfulness of any data processing that has occurred up until your withdrawal of consent.

Right of data portability
You have the right for the data we automatically process based on your consent or in fulfillment of a contract to be provided to you or a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done if it is technically feasible.

Right to lodge a complaint
In the event there are violations of the GDPR, the data subject has the right to lodge a complaint with a supervisory authority, particularly in the Member State of his or her habitual residence, place of work or place of the alleged violation. The right to lodge a complaint is without prejudice to other administrative or judicial remedies.
